Please read these terms and conditions (“Terms”) carefully before using Our Website as they affect Your rights and liabilities under law. By using this Website, You agree to be bound by these Terms including Our Disclaimer, Returns Procedure and Privacy Policy.

1. 1. Definitions and Interpretations

   1. 1.1 In these Terms the following words shall mean:

      You, Your the person or organisation using the Website or buying Goods from Us pursuant to these Terms.

   2. 1.2In these Terms references to “in writing” shall include e-mail. Any queries regarding these Terms, the Goods or Your Order must be made to the Contact Address.

2. 2. Goods Information

   1. 2.1 We have made all reasonable efforts to accurately describe the Goods (include size, interoperability and colour) for sale on Our Website. You acknowledge and accept however that You are responsible for ensuring that the Goods are suitable for your requirements.

   2. 2.2 With regards to our own brand, Think, We guarantee that all Goods will perform to a standard no less than would be expected from the same original product. We will exchange any Goods which fail to conform to the guarantee within one year from the date they were ordered. This clause sets out our entire liability for any fail to meet the guarantee.

   3. 2.3 Our Price Promise is given subject to the following:

      • 2.3.1 it relates only to new identical goods sold in the United Kingdom;

      • 2.3.2the Price Promise does not include comparisons with any goods which are sold under any sale or special promotion including without limit Christmas or seasonal sales;

      • 2.3.3price comparisons exclude sales by auctions (including internet auction sites);

      • 2.3.4price comparisons do not include goods sold on hire purchase or sold privately;

      • 2.3.5price comparisons do not include goods sold in bulk or offered by trade companies.

   4. 2.4We reserve the right to substitute our own branded goods, Think, with an alternative product of the same high quality should we be out of stock at the time of order so long as it meets the same specification.

   5. 2.5Your contract for purchases is with Us, and you undertake that any and all goods ordered by you are for your own private and domestic use only.

3. 3. The contract between you and us

   1. 3.1 We must receive payment of the whole price for the Goods that You order before your Order can be accepted. Once payment has been received by Us We will confirm that Your Order has been received by sending an e-mail to You at the email address You provide in your Order. Payments are handled by SagePay – The UK’s leading independent payment provider.

   2. 3.2 You have the right to cancel the Order up to the point at which the Goods are ready to be dispatched by Us. If you wish to cancel pursuant to this clause then You must notify Us in writing. Should You cancel Your Order before the goods are ready to dispatch We will refund in full the amount forwarded by You within [21] days of the Order being cancelled. Credit card charges will be refunded on the same credit card only. If in the event of being too late to stop your order we will advise you of this and offer our normal returns procedure.

   3. 3.3 Our acceptance of an Order does not take place until dispatch of the Order, at which point a Contract will be made. Any notification e-mails are acknowledgments, not acceptance of your order.

4. 4. Price

   1. 4.1 Subject to this clause 4, the price payable for Goods are as set out in Our Website at the time of order;

   2. 4.2 The prices payable for goods as set out in the web site are inclusive of shipping and handling costs.

   3. 4.3 Consignments imported by individuals to the UK of a value of £17.99 or under are relieved from import VAT and duties under current legislation.

   4. 4.4 For goods priced at £18 and above imported by you into the UK we will, unless you inform us otherwise, arrange for VAT at the current rate and any applicable Customs duty due on your importation to be paid to HM Revenue and Customs. This procedure is for your convenience only and is specific for the importations you make into the UK. This arrangement does not change any of the relevant terms and conditions mentioned in this document. For the avoidance of doubt, you are and will remain the importer of all goods ordered by you and shipped to an address outside Guernsey and will at all times remain liable for any import VAT, Customs or other duty chargeable thereon.

   5. 4.5 For purchases by UK businesses, no evidence of payment of UK import VAT can be provided or reclaimed.

   6. 4.6 We will, unless you inform us otherwise, arrange for VAT at the current rate to be paid to HM Revenue and Customs on items or orders over £17.99 (excluding delivery).

   7. 4.7 Prices are subject to change without notice.

5. 5. Right of Cancellation

   1. 5.1 Notwithstanding clause 3and subject to your compliance with the remainder of this clause 5, You may also cancel Your Order at any time up to the end of the seventh (7th) working day starting from the date immediately after you receive the ordered Goods provided those Goods are unused, with all labels and tags intact and attached and in no worse condition that when they were received by You.

   2. 5.2 To cancel your Order You must notify Us in writing before the end of the period set out in clause 5.1.

   3. 5.3 All cancellations should be undertaken in accordance with and subject to Our returns procedure set out below.

   4. You must send the Goods back to Our Contact Address at Your own cost and risk and quoting the returns number issued (see clause 5below).

   5. 5.4 Before You send your Goods follow our returns procedure to obtain a returns authorisation number. We reserve the right to refuse or dispose of packages not displaying this number.

   6. 5.5 Once You have notified Us that You are cancelling Your Order, any sum debited to Us from Your credit card will be re-credited to Your account as soon as possible and, in the event that the Goods have been dispatched, within [21] days of your cancellation notice PROVIDED THAT the Goods in question are returned by You and received by Us in the condition they were in when delivered to You and in their original packaging. If applicable, We shall be entitled to deduct the direct costs of recovering the Goods from the amount to be re-credited to You.

6. 6. Cancellation by Us

   1. 6.1 We reserve the right to cancel the Contract if:

      1. We have insufficient stock to deliver the Goods You have ordered; or

      2. We do not deliver to Your area or country; or

      3. if one or more of the Goods You ordered was listed with incorrect information including without limit price, and/or description for whatever reason; or

      4. if We have reason to believe that You will not comply with these Terms.

7. 7. Delivery of Goods to You

   1. 7.1 Subject to clause 7.4, We will deliver the Goods ordered by You to the address You give Us for delivery at the time You make Your Order.

   2. 7.2 Delivery will be made as soon as possible after your Order is received and we will (where possible) dispatch your Goods on the same working day as you place the Order*. (Usually this means orders received by 1200 noon Monday to Friday, after this time your order will be dispatched the following working day - subject to stock availability).
      *We now guarantee that, subject to stock availability and technology allowing, if we receive your order by noon Monday - Friday (excluding Bank Holidays) we will dispatch it that same working day - or your money back. The item must be in stock and readily available, your order paid and accepted in full and printed in our warehouse by 12 noon in order to qualify.

   3. 7.3You will become the owner of the Goods you have ordered when they have been delivered to You. Once Goods have been delivered to You they will be held at Your own risk and We will not be liable for their loss or destruction.

   4. 7.4Delivery is made by Royal Mail first class post and can take 2-5 working days from dispatch. Please note that orders may be part shipped in more than one package.

   5. 7.5We cannot be held responsible for delays or lost packages if an incorrect or incomplete address is supplied.

8. 8. Liability and Limitation

   1. 8.1 If the Goods We deliver are not what You ordered or are damaged when You receive them or the delivery is of an incorrect quantity, We shall have no liability to You unless you notify Us in writing at our Contact Address of the problem within seven (7) working days starting from the date immediately after the delivery of the Goods in question.

   2. 8.2 Save as precluded by law, We will not be liable to You for any indirect or consequential loss, damage or expenses ( including loss of profits, business or goodwill) howsoever arising and in any event our maximum liability to You shall be to refund to You the amount paid by You for the Goods giving rise to the claim.

   3. 8.3 You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase Goods from Our Website. The importation or exportation of certain of our Goods to You may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the Goods you purchase.

   4. 8.4 Notwithstanding the above, nothing in these Terms is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to You for any death or personal injury resulting from Our negligence.

   5. 8.5 You acknowledge and accept that save as expressly stated on the Website We give no representation, warranty or statement as to the Goods including without limit their quality and/or suitability.

9. 9. Notices

   1. 9.1 Unless otherwise expressly stated in these Terms, all notices from You to Us must be in writing and sent to Our Contact Address.

   2. 9.2 You accept that email can be used, and is an acceptable means of long distance communication.

10. 10. Events beyond our control
    We shall have no liability to You for any failure to deliver Goods You have ordered or any delay in doing so or for any damage or defect to Goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs, terrorism and other industrial disputes, breakdown of systems or network access, flood, fire, explosion, accident or adverse weather conditions.

11. 10.1 Invalidity
    If any part of these Terms is unenforceable (including any provision in which We exclude our liability to You) the enforceability of any other part of these conditions will not be affected.

12. 10.2 Privacy
    You acknowledge and agree to be bound by the terms of our Privacy Policy.

13. 10.3 Returns procedure
    You acknowledge and agree to be bound by the terms of our Returns Procedure.

14. 10.4 Third party rights
    A person who is not a party to this Contract has not got any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any terms of this Contract but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

15. 10.5 Governing law
    This Contract shall be governed by and interpreted in accordance with Guernsey law and the Guernsey Courts shall have jurisdiction to resolve any disputes between us.

16. 10.6 Complaints
    If You have any concerns or complaints about the Goods, this Website or the service You have received then please write to the Contact Address for the attention of The Customer Services Manager. All complaints will be acknowledged within 48 hours of receipt.

17. 10.7 Entire Agreement

    1. 10.7.1 These Terms, together with out current Website prices, delivery details, returns procedure and privacy policy, set out the whole of our agreement relating to the supply of the Goods to You by Us. Nothing said by any sales person on our behalf should be understood as a variation of the Terms or as an authorised representation about the nature or quality of any Goods offered for sale by Us. Save for fraud or misrepresentation, We shall have no liability for any such representation being untrue or misleading.

    2. 10.7.2 Additional terms and conditions may apply for prize competitions, pre-release orders and our added value services and offers. If so, you will be alerted to them at the relevant juncture.
